Criminalizes sharing another person's private sexual images without written consent when done to profit or to harm, harass, or coerce, and clarifies that consent to create an image is not consent to distribute it. Sites and apps that distribute such images must take them down at the depicted person's request without charging a removal fee, and face daily civil damages if they do not.

Class A misdemeanor for a first offense and Class D felony thereafter; Class D felony (first) and Class C felony (subsequent) when done for profit. Website operators that fail to remove an image on request are civilly liable for $1,000 per image per day; two-year limitations period.

Practices it requires

  • Do not distribute private erotic matter to a third party without the depicted person's written consent when intending to profit or to harm, harass, intimidate, threaten, or coerce; consent to creation is not consent to distribution.KRS 531.120(1), (5)
  • Operators of websites or apps that distribute private erotic matter must remove an image on request of the person depicted and may not solicit or accept a fee to remove it.KRS 531.120(3)

Other duties

  • A depicted person may sue an operator that fails to remove an image for $1,000 per image per day after the request, whether or not criminal charges were brought, within two years.KRS 411.215
