OK Security Freeze Act

Lets Oklahoma residents place a security freeze on their credit reports so consumer reporting agencies cannot release the report or score for new credit without the consumer's authorization. Sets deadlines for placing, temporarily lifting, and removing freezes and gives consumers a damages remedy.

Willful noncompliance: actual damages plus costs and reasonable attorney fees; negligent noncompliance: actual damages plus costs and fees. A person who obtains a report or requests a freeze or lift under false pretenses is liable to the agency for the greater of actual damages or $1,000.

  • Consumer reporting agencies (as defined in the federal FCRA) holding consumer reports on Oklahoma residents
  • Resellers, check-services or fraud-prevention companies, and deposit account information services are not required to place freezes (resellers must honor freezes placed by others)

What a privacy notice must say

  • Within 10 business days send written confirmation and a unique PIN or password, and explain how to temporarily lift the freeze or allow access for a period of time.24 O.S. § 151(C)-(D)
  • Include notice of freeze rights in the consumer summary of rights.24 O.S. § 158

Rights it gives people

  • Consumers may request a security freeze in writing; the agency must place it within 5 business days of receiving the request, proper identification, and any fee.24 O.S. § 151(A)-(B)

Practices it requires

  • Temporarily lift a freeze within 3 business days of a complete request; agencies may offer expedited phone, fax, or internet procedures.24 O.S. § 152
  • Release of a frozen report for new credit is prohibited without consumer authorization, subject to statutory exceptions (such as existing creditors and government agencies).24 O.S. §§ 150(5), 155
