Regulates automated calls and texts that play prerecorded or synthesized messages: they must disconnect promptly, offer a one-digit opt-out, and avoid emergency and health numbers, opted-out subscribers, and (for random or sequential dialing) do-not-call listed numbers. Callers may not misrepresent their identity or purpose or spoof caller ID.

Penalties
Unlawful trade practice with civil penalty capped at $5,000 per violation (ORS 646A.376). Violations of ORS 646A.374 are also unlawful practices under ORS 646.608(1)(ff), privately actionable for actual damages or $200 (ORS 646.638).

  • Callers using automatic dialing and announcing devices to call or text Oregon subscribers (ORS 646A.370)
  • Persons that knowingly provide substantial assistance to spoofing or misrepresentation violations, other than common carriers (ORS 646A.374(5), (7))

Practices it requires

  • Device must disconnect within 10 seconds after the subscriber hangs up and offer, within the first 10 seconds, a one-digit or keypress way to opt out of future calls (not required for debt collectors, public safety, or established business relationships).ORS 646A.372(1)
  • Exclude emergency, hospital, health care, poison control, and crisis-line numbers and subscribers who opted out from the dialing range.ORS 646A.372(2)-(3)
  • Random or sequential dialers must exclude numbers on official government do-not-call lists, with listed exceptions.ORS 646A.372(4)
