Requires anyone using prerecorded autodialers for solicitation to register with the Attorney General's consumer protection bureau, identify themselves and the call's purpose, and disconnect promptly, and bans solicitors from blocking or spoofing caller ID. It also incorporates the national do-not-call registry and the FTC Telemarketing Sales Rule into state law, with state penalties and a private right of action.

Penalties
Autodialer and caller ID violations are unfair or deceptive acts under RSA 358-A (civil penalties up to $10,000 per violation). Do-not-call violations: DOJ civil penalty of $5,000 per violation; injured persons may recover actual damages or $1,000, whichever is greater, up to treble for willful or knowing violations. A safe harbor applies for telemarketers with documented compliance programs.

What a privacy notice must say

  • Autodialed solicitation messages must immediately disclose the caller's name and the purpose of the call and goods or services offered.RSA 359-E:5

Practices it requires

  • Autodialers must disconnect within 30 seconds after the called party hangs up and must not reach emergency lines.RSA 359-E:4; 359-E:2, III
  • Do not block caller ID when soliciting; transmitted caller ID must include a callback number and must not be misleading, inaccurate or deceptive.RSA 359-E:5-a
  • Do not make telemarketing sales calls to customers registered on the national do-not-call registry, and comply with the FTC Telemarketing Sales Rule for calls into New Hampshire.RSA 359-E:8
  • Obtain quarterly New Hampshire do-not-call listings from the list administrator (FTC).RSA 359-E:9
