Nonconsensual dissemination of private sexual images (including AI-generated depictions)

Criminalizes disseminating sexual images obtained under circumstances indicating they were to remain private, without the depicted person's consent. A 2025 amendment (Laws 2025, c. 23, effective November 1, 2025) extends the crime to artificially generated sexual depictions ('deepfakes') disseminated to harass or harm the depicted person.

Misdemeanor (up to one year and $1,000 fine); Class D1 felony when the offender seeks something of value or disseminates three or more images within six months, with sex offender registration for repeat extortion-type offenses; forfeiture and court-ordered removal.

  • Any person who disseminates private sexual images of another, or artificially generated sexual depictions of another, without consent
  • Interactive computer services, wireless providers, and broadband providers are not liable solely for third-party content

Practices it requires

  • Do not intentionally disseminate an image of another person engaged in a sexual act or with intimate parts exposed, obtained under circumstances indicating it was to remain private, without that person's effective consent.21 O.S. § 1040.13b(B)
  • Do not disseminate an artificially generated sexual depiction of another person (created with AI or photo-editing tools) without consent, with intent or reckless disregard to harass, threaten, or cause harm.21 O.S. § 1040.13b(B)(2) (version 1, Laws 2025, c. 23) · From 2025-11-01

Other duties

  • Courts may order a convicted defendant to remove disseminated images where within the defendant's power.21 O.S. § 1040.13b(I)
